Do I need a lawyer to get divorced?
The simple answer is “no”. Anyone can represent herself or himself in Court. In fact, many Counties in Wisconsin offer simple “fill-in-the-blank” forms for unrepresented parties to complete to go through the divorce process. However, this procedure works best with couples who have very limited assets, no children and no real estate. Complications arise for most couples when they take into consideration the sale or transfer of a marital home, the care and custody of their children, and the responsibility for marital indebtedness. Other factors that often require expert advice for divorcing couples include the rules governing income tax, spousal support and the transfer or division of retirement accounts.
